In Florida Is kissing illegal and considered sexual contact if the adult is 25 and the minor is 17?
My friend is now 25 and is concered about dating a minor under the age of consent in Florida. What is legal and illegal in a relationship of this sort. She wants to date a 17 year old but does not know the laws.
From a strictly legal standpoint, kissing is OK. Sexual activity isn't. Here's the Florida statute:
"794.05 Unlawful sexual activity with certain minors.--
(1) A person 24 years of age or older who engages in sexual activity with a person 16 or 17 years of age commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. As used in this section, "sexual activity" means oral, anal, or vaginal penetration by, or union with, the sexual organ of another; however, sexual activity does not include an act done for a bona fide medical purpose."
From a moral standpoint, you will find that many people would oppose such a relationship, especially the parents of the 17-year old boy, and I am inclined to think that she is engaging in inappropriate behavior. She would be more compatible with a man closer to her own age.
